IPCo’s 516 Patent Claims Validated in ex-parte Re-examination Finding by United States Patent Office
Atlanta Georgia, - Aug 14, 2008 – IPCo LLC d/b/a IntusIQ, a world leader in wireless communication systems and applications, today reported that it has received an action from the U.S. Patent Office confirming the patentability of 19 out of 19 claims in U.S. Patent 6,249,516 with no amended or modified claims, and meaning that all the claims in the 516 Patent were reaffirmed as being allowed by the U.S. Patent Office.
In the United States District Court Northern District of California (Case No. 08-mc-80126-MMC), Zigbee’s counsel acknowledged that “Zigbee anonymously filed Requests for Reexamination of two of IPCO’s patents in or around April, 2006.”The anonymous filing regarding the IPCO ‘516 and ‘062 patents was undertaken by DLA Piper US LLP, one of the world’s largest law firms.
Almost two years ago, IPCO agreed to stay litigation against Cellnet Technology Inc. and Tropos Networks, Inc. while the Patent Office further considered two of IPCO's patents. The law suit alleged infringement of U.S. Patent 6,249,516. Cellnet became a board member of Zigbee on April 23, 2007.
"Today we received notification from the U.S. Patent Office, confirming patentability of all the claims in the ‘516 patent," said Oliver Lee, Chairman of IPCO. "This is a great outcome, re-affirming the validity of the patent. We expect the re-examination certificate to be issued soon. Having been temporarily foreclosed from proceeding with its patent infringement counts by the reexamination process, this decision should permit us to immediately resume the Cellnet and Tropos Networks lawsuits."

ZIBGEE FILES ANONYMOUS RE-EXAMINATION OF TWO OF IPCO LLC'S PATENTS
In an Amended Opposition to Compel Production of Documents in Case No. 08-mc-80126-MMC in the United States District Court Northern District of California, Zigbee’s counsel admits that “Zigbee anonymously filed Requests for Reexamination of two of IPCO’s patents in or around April, 2006.”The anonymous filing was undertaken by DLA Piper US LLP, one of the world’s largest law firms.
Ed Calloway of Motorola states in his declaration “Since its formation, Zigbee has become a global organization of more that 270 member companies. Zigbee membership includes worldwide technology providers, such as Texas Instruments and Motorola, as well as smaller equipment manufacturers.”

IPCO, LLC EXECUTES EWMTM GATEWAY LICENSE AGREEMENT WITH BROADBAND ENERGY NETWORKS

Reno Nevada Sept. 30, 2007 IPCo, LLC (IPCo) and Broadband Energy Networks Inc. (BEN) announced today that they have completed a licensing deal for the IPCo 6,044,062 family of patents for its C2k Automation Gateway and UNI-PLEX Energy Applications Platform.
The UNI-PLEX C2k Automation Gateway is the core of Broadband Energys complete Automation Computer solution for network integration, communications and automation across incompatible systems and protocols. PLAINTIFFS CHEER RULING ON VERY VALUABLE PATENTS

In fight over wireless technology, judge deals blow to Cellnet a Alpharetta Georgia company, but their lawyer says ruling in minor

FRIDAY, JULY 20, 2007 - THE PLAINTIFFS IN a high-stakes patent infringement case said a recent ruling by a federal judge is a major step toward their gaining the rights to several wireless data transmission patents estimated to be valued in the hundreds of millions of dollars.
The case involves efforts by an metro-Atlanta technology developer, IPCo LLC, to secure the rights to patents dealing with "Wireless Gateway" or "mesh" technology. According to the companys lead attorney, John C. Herman of Duane Morris Atlanta office, the technology is widely used for remote meter-reading by utilities and is increasingly relied upon by municipalities installing Wi-Fi networks.
The case involves several companies. The patents in question were previously held by StatSignal Systems, which was founded by Atlanta engineer and inventor T. David Petite and attorney-turned-entrepreneur Oliver Lee; the two later left StatSignal to form Alpharetta-based IPCo and a sister company, SIPCO, which hold several wireless patents
.
StatSignal was bought by Minnesota-based Hunt Technologies in 2006. Hunts parent company, Australias Bayard Group, announced its acquisition of CellNet Technology in January 2007 for $700 million.
IPCo and SIPCO contend that, when StatSignal was purchased, it was contractually required to offer IPCO the right to purchase the patents. But they were transferred to Hunt, and then licensed to CellNet.
Last December, IPCo sued CellNet in the U.S District Court in Atlanta seeking unspecified damages and demanding that CellNet stop licensing or distributing the technology. The suit also named another company, California-based Tropos Networks, which CellNet licensed to use the technology in its wireless network installations, as a defendant.
Hunt was added to the suit as an intervenor.
Both CellNet and Hunt claimed that, when IPCO filed its suit, it triggered a contractual stipulation allowing CellNet to retain title to the patents. But on July 10, U.S. District Court Judge Julie E. Carnes said she had concluded that CellNet and Hunt "are not likely to succeed" in their contention.
"Accordingly," she wrote, "CellNet has failed to demonstrate that ownership of the patents in question will thereby revert to CellNet or Hunt."
Carnes ordered CellNet and Hunt to immediately cease "assigning, licensing, granting security interest or otherwise conveying or encumbering" five of the disputed patents.
Carnes also ordered that her ruling be filed with the U.S. Patent and Trademark Office, a move IPCo lawyer Herman described as unusual.
"This important ruling goes a long way to clearing our clients title to these patents and enabling our clients to continue to offer their innovative mesh networking technology to the marketplace without interruption," said Herman.
Efforts to reach CellNet Vice President and General Counsel Ellie A. Doyle and lead counsel Nagendra "Nick" Setty, managing principal at Fish & Richardsons Atlanta office, for comment on Carnes ruling were unsuccessful.
In earlier communications, Doyle had declined to discuss the case.
Despite Hermans claim of victory, Setty last month told the Daily Report in an e-mail that the requirements of the judges order which were known to be forthcoming constituted "extremely minor relief to which our clients had consented (yes, consented), denying the lions share of what [IPCo] sought.
."
But IPCos chief executive officer, Lee, said the ruling "is ideal for us. It really reflects an understanding of what our position has been all along and gives us an opportunity to get back to using the technology that we, in fact, invented."
Lee said he was a securities lawyer at Troutman Sanders some 15 years ago when he met Petite, whom he described as a "fairly prolific inventor." After several years, the two formed StatSignal to develop various wireless technology devices and methods of transmission Petite designed and acquired other patents. Their more recent ventures, IPCo and SIPCO, currently have a portfolio of more than 20 high-tech patents, he said.
Lee declined to speculate on the value of the patents in the current case, only describing them as "very, very valuable" and pointing out that the technology which is in use in several U.S. cities as part of utilities operations or metropolitan wireless networks is already used by millions of consumers.
Still to be resolved, he said, is whether Hunt and CellNet were bound by the previous arrangement to offer IPCo the patents on a first-refusal basis, which if IPCO prevails it will acquire for the same price Hunt paid, which has not been disclosed.
"Theyre going to fight us tooth and nail on that," said Lee.
The case is IPCO v. CellNet Technology, No. 1:06-CV-03048.
That case is not the only dispute between the sides. Another matter brewing is a suit filed by IPCo against CellNet in 2005, seeking more than $200 million for unrelated claims of patent infringement. That case, before U.S. District Court Judge Clarence Cooper, is IPCO v. CellNet Technology, No. 1:05-CV-02658.

COURT ENJOINS BAYARD GROUP'S- HUNT TECHNOLOGIES AND CELLNET TECHNOLOGY OVER CLAIMS OF OWNERSHIP OF IPCo's KEY WIRELESS MESH PATENTS

ATLANTA, GEORGIA -Monday, Jul 16, 2007---
This past week Federal Judge Julie E. Carnes of the U.S. District Court for the Northern District of Georgia, granted IPCos Preliminary Injunction against two companies recently acquired by the Bayard Group out of Australia, CellNet Technology Inc and Hunt Technologies LLC requiring the Order to be filed with the U.S. Patent and Trademark Office. For the purpose of the court proceedings IPCo is used to define SIPCO LLC and IPCo LLC.
Judge Carnes enjoined CellNet and Hunt from filing any claims of ownership, assigning or licensing IPCos wireless mesh networking patents which Hunt had unilaterally seized and to which it claimed ownership. The patents in the case are U.S. Patent Numbers 6,891,838; 6,914,893 and 7,103,511; and U.S. Patent Application Numbers 09/925/786 and 09/925,270.

The dispute arose after IPCo filed a patent infringement suit against CellNet and Tropos Networks with US Patent Number 7,103,511, in December 2006, prior to the Bayard Group acquiring CellNet. The Bayard Group which acquired Hunt Technologies in March 2006 also bought StatSignal Systems Inc. in July 2006.
Prior to the Bayard Group's acquisition of StatSignal Systems Inc the majority investors had split the assets of the company in 2004 in order to maximize their returns. StatSignal Systems Inc, retained limited rights to operate as an AMR "Automatic Meter Reading" technology company, while all other non AMR intellectual property was spun off into a second company StatSignal IPC now operating as SIPCO which would license its patents and technology for all other applicable uses. IPCo obtained those rights and now licenses this IP.
In early March 2007, following Bayards acquisition of CellNets in January 2007, Bayards company, Hunt Technologies sued IPCo claiming that IPCo breached the original contract with StatSignal Systems by suing CellNet within the restricted Utility Field of Use and had thereby triggered a forfeiture clause in the contract. The court found in favor of IPCos Preliminary Injunction concluding CellNet and Hunt were not likely to succeed in their contention that the patent infringement claim asserted infringement in the Utility Field of Use. Judge Carnes further ordered that IPCO file with the USPTO the Order with each of the patents and applications.
The 511 patent suit followed another earlier patent pending infringement case brought by IPCo against CellNet in 2005 that involves the 516 and 062 patents which where patents IPCo acquired in November 2004 and have unlimited Fields of Use, universally applying to almost any type wireless mesh systems including AMR and Wi-Fi Broadband markets. This case is also being prosecuted in the US District Court for the Northern District of Georgia before Judge Clarence Cooper.
In the proceedings before Judge Carnes, CellNet had filed a Motion for Summary Judgment against IPCo, claiming that the suit was moot because the patents were owned by Hunt. However, Carnes dismissed the motion. The Hunt suit filed against IPCo in March 2007 was dismissed and consolidated into IPCo's lawsuit.
IPCo filed a motion to amend its complaint to include Hunt Technologies, and B&L Tech Inc (previously operating as StatSignal Systems Inc). IPCo strongly believes that it is entitled to purchase all of the assets of StatSignal, including all patents, under the terms of the 2004 spin-off agreement with StatSignal Systems. Consequently, IPCo is seeking specific performance under its Right of First Refusal in that agreement.

IPCO LLC RELOCATES TO LARGER OFFICE

ATLANTA GEORGIA, January 12, 2007IPCo LLC. recently announced plans to move its corporate office toOverlook I in Vinings Business Park. The new office will be approximately two miles from its current location in Cobb County Georgia
For IPCo, an Intellectual Property research development firm exclusively serving wireless communications companies, the new office space means improved client service, new amenities for employees and room for growth.

IPCO LLC FILES SECOND WI-FI MESH PATENT LAWSUIT AGAINST TROPOS NETWORKS, INC

ATLANTA GEORGIA January 4, 2007 IPCo LLC has filed another patent infringement lawsuit against Tropos Networks, Inc. According to the civil action filed by IPCo LLC, Tropos Networks, Inc. wireless system infringes the IPCo U.S. Patent No. 7,103,511, which was issued to the plaintiff in 2006. IPCo filed suit in the U.S. District Court for the Northern District of Georgia.
This is the second patent lawsuit filed in Georgia by IPCo against Tropos in less than a year. On March 13, 2006, IPCo filed its first patent infringement suit against Tropos in the United States District Court for the Northern District of Georgia, alleging that Tropos is infringing IPCo 6,249,516patent.
"We have been granted a number of patents developing wireless technology since the early to mid 90s, and as any company developing technology, we are only seeking to protect our essential property rights awarded to us by the United States Patent Office" says Oliver Lee, Chief Executive Officer of IPCo LLC.

According to the civil action filed by IPCo LLC, Cellnet Technologies, Inc. wireless system infringes the IPCO U.S. Patent No. 7,103,511, which was issued to the plaintiff in 2006. IPCO filed suit in the U.S. District Court for the Northern District of Georgia.
This is the second patent lawsuit filed in Georgia by IPCo against Cellnet. On October 19, 2005, IPCo filed its first patent infringement suit against Cellnet in the United States District Court for the Northern District of Georgia, alleging that Cellnet is infringing IPCo 6,249,516patent.

IPCO LLC, FILED ANOTHER PATENT INFRINGEMENT LAWSUIT, THIS TIME ALLEGED AGAINST CELLNET TECHNOLOGY, INC. IN DISPUTE OVER WIRELESS MESH NETWORK GATEWAY SYSTEM

ATLANTA Oct 19, 2005 A local Atlanta based wireless communications research development company IPCo LLC filed a lawsuit for patent infringement against a wireless technology provider for utility meter reading products, Cellnet Technology, Inc. Based on current projections, IPCo LLC will seek as much as $200 million in total damages.
According to the civil action filed by IPCo LLC, Cellnet Technology, Inc. wireless system infringes the IPCo U.S. Patent No. 6,249,516, which was issued to the plaintiff in 2001. IPCo filed suit in the U.S. District Court for the Northern District of Georgia.
The IPCo 516 patent, titled "Wireless Network Gateway and Method for Providing Same," relates to system and method using wireless mesh technology. The defendant, a provider of wireless electricity, water, gas, metering reading communications solutions, and metering automation systems, created the "Infinet Utilinet" to aid utilities and retail energy providers. The program provides users with a system that features "smart" meters and fully automated, intelligent two-way communications that make on-request meter reads and server-installed commands a reality, according to Cellnets Web site.
This is the second time in recent months IPCo LLC has asserted its wireless mesh patents. Last June IPCo filed patent infringement suit in the Federal Court in the Northern District of Georgia, against Elster Electricity LLC for using wireless mesh technology with automatic meter reading devices. In both cases IPCo's patent infringement complaint alleged that both defendants are infringing on at least one or more claims of the IPCo patent by defendants selling wireless mesh network gateway systems.
